1. Who we are

This store is operated by Aggressively Creative LLC ("Aggressively Creative," "we," "us," "our"), a limited liability company organized in the State of Colorado, United States. You can reach us at hello@aggressivelycreative.com.

2. Agreement to these terms

By visiting aggressivelycreative.com or placing an order, you agree to these Terms of Service, along with our Returns & Exchanges Policy, Shipping Policy, and Privacy Policy, each of which is incorporated here by reference. If you do not agree with any part of these terms, please do not use the site or place an order.

3. Eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. By ordering, you confirm that the payment method you use is yours or that you are authorized to use it.

4. Everything here is made to order

We do not hold inventory. Each item is printed or embroidered after you place your order, by our production partner, and shipped directly to you. This shapes everything below, particularly cancellations, returns, and delivery timing.

Once an item enters production it cannot be stopped, altered, or recalled.
We cannot swap sizes or colors, because there is no stock to swap from.

5. Products, colors, and sizing

We describe our products as accurately as we can, but:

Colors vary between screens. Your monitor or phone renders color differently than the fabric will. Garment dyes also vary between production runs, particularly on heather and garment-dyed items.

Product images are often mockups. Where we use a mockup rather than a photograph of the finished item, print placement and scale are representative rather than exact. Minor variation in placement is normal in made-to-order printing and is not a defect.

Sizing runs differently across brands and cuts. We publish garment measurements where we have them. Please check them before ordering, or email us and we will help. We cannot accept returns for sizing (see Section 10).

6. Pricing and errors

All prices are in US dollars and are subject to change without notice. Prices shown at checkout are the prices that apply to your order.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with an incorrect description. We reserve the right to correct errors and to cancel or refuse any order placed at an incorrect price, whether or not the order has been confirmed and your payment method charged. If this happens, we will contact you and issue a full refund.

7. Orders, acceptance, and our right to refuse

Your order is an offer to buy. We may accept or decline it.

We reserve the right to refuse or cancel any order, for any lawful reason, including suspected fraud, an unauthorized payment method, a shipping address we cannot verify, quantities that appear intended for resale, or an order we believe is placed in bad faith. If we cancel an order you have already paid for, you receive a full refund.

We are a small independent business. We do not accept wholesale or bulk orders through this site.

8. Payment

Payment is taken at checkout. We accept the payment methods shown at checkout, which may change over time. Payments are processed by third-party payment providers. We never see or store your full card details. Your use of a payment method is also subject to that provider's terms. Sales tax is calculated and applied at checkout where applicable.

9. Shipping, delivery, and risk of loss

Delivery estimates are estimates, not guarantees. We cannot guarantee delivery by a specific date, and we are not responsible for carrier delays, weather, or other events outside our control.

Title and risk of loss pass to you when the carrier takes possession of the package. That said, if a package is genuinely lost in transit, contact us and we will make it right under our Returns & Exchanges Policy.

You are responsible for providing an accurate shipping address. Packages sent to an address you entered incorrectly, and packages returned as undeliverable, are subject to a reshipping charge. Details are in our Shipping Policy.

10. Returns, replacements, and cancellations

Our full Returns & Exchanges Policy governs this and forms part of these terms. In summary:

If something is wrong on our end — damaged, defective, misprinted, the wrong item, or lost in the mail — email us within 21 days of delivery with your order number and a photo. We will send a replacement or refund you in full. You will not need to send anything back.

If it is a sizing issue or a change of mind, we are not able to offer a return or exchange, because your item was made specifically for you and cannot be returned to stock or resold.

Cancellations: email us within 12 hours of ordering and we will do our best. Once an item is in production we cannot stop it.

Nothing in this section limits any rights you have under applicable consumer protection law.

11. Our intellectual property

All designs, artwork, illustrations, text, logos, photographs, and other content on this site are owned by Aggressively Creative or used with permission, and are protected by copyright and other laws.

When you buy a product, you are buying that physical product, not the design on it. You may not reproduce, copy, screen-print, embroider, digitize, resell, or commercially exploit any of our designs, or use our artwork to create derivative products, listings, or merchandise of your own. Please do not upload our artwork to print-on-demand platforms.

12. Satire, commentary, and opinion

Some of our designs are works of satire, parody, social commentary, or political opinion. They are creative expression, offered as such.

They are not statements of fact, and they are not claims about any real person, company, product, or organization. They do not imply any affiliation with, sponsorship by, or endorsement from any third party.

Where a design references a public figure, an institution, or a cultural work, the reference is commentary. Any third-party names or marks that appear are used nominatively, to refer to the subject being commented on, and remain the property of their respective owners.

13. Your content

If you post a review, tag us, send us a photo, or otherwise submit content to us or about us:

You confirm you own it or have the right to share it.
You grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content for marketing and promotional purposes, including on our website and social media, with credit where practical.
You can ask us to stop using it at any time by emailing us, and we will remove it going forward.

We may remove any submitted content for any reason.

14. Prohibited uses

You agree not to use the site for any unlawful purpose or to violate anyone's rights; attempt to gain unauthorized access to the site, its systems, or other users' data; scrape, harvest, or systematically extract data from the site; interfere with or disrupt the site's operation or security features; upload malicious code; impersonate us or any other person; or use the site to harass, abuse, or harm anyone. We may terminate your access for any violation of this section.

15. Third-party services

Our store runs on the Shopify e-commerce platform, and our products are produced and shipped by Printful, a third-party print-on-demand fulfillment provider. Payment processing, analytics, and email are also handled by third parties.

Your use of the site is therefore also subject to the terms and privacy practices of these providers. We are not responsible for the acts, omissions, or policies of third parties, though we remain your point of contact and will always advocate for you with them. Our site may link to other websites we do not control and are not responsible for.

16. Disclaimer of warranties

The site and everything on it are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, Aggressively Creative LLC and its owner, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the site or any product purchased from us, even if we have been advised of the possibility.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing here limits liability that cannot lawfully be limited.

18. Indemnification

You agree to indemnify and hold harmless Aggressively Creative LLC and its owner from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

19. Governing law and where disputes are heard

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Any dispute arising out of these terms or your use of the site will be brought in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts. This does not prevent either of us from bringing a claim in small claims court where it qualifies.

Before filing anything, please email us. Most problems are a misunderstanding and take one message to fix.

20. Severability and entire agreement

If any provision of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in Section 2, are the entire agreement between us regarding your use of the site.

21. Changes to these terms

We may update these terms at any time by posting a revised version with a new "last updated" date. Changes take effect when posted. The version in effect when you place an order is the version that governs that order.
